General Terms and Conditions (GTC) for sightseeing tours​
1. Scope of application
These General Terms and Conditions (hereinafter: GTC) apply to all services offered by ‘myVeloTour Berlin’ of Leonardo Daloiso, Grellstr. 5B, 10409 Berlin (hereinafter: ‘Contractor’).
With your booking you recognise these terms and conditions.

2. Conclusion of contract
2.1 By booking a city sightseeing tour, the customer submits a binding offer to conclude a contract.
2.2 The contract is concluded when the provider confirms the booking in writing or in text form.

3. Services
3.1 The scope of the services is set out in the respective service description and the booking confirmation.
3.2 The provider reserves the right to make changes to the execution of the tour if these are necessary due to unavoidable, exceptional circumstances and do not significantly affect the execution of the tour as a whole.

4. Prices and payment
4.1 The prices are per vehicle (up to 2 adults and a 6-year-old child) and include the specified services.
4.2 Payment is usually made by bank transfer or cash before the start of the tour.
4.3 In the event of non-payment, the provider is entitled to withdraw from the contract.

5. Vouchers
Issued vouchers are only valid after receipt of payment and cannot be exchanged for cash. They are valid for 3 years. The voucher must be handed over to the tour guide at the start of the tour.
6. Cancellation, withdrawal, rebooking
6.1 The contractor always endeavours to keep his appointments. If a tour has to be cancelled due to exceptional circumstances, the participants are entitled to a refund of the payments made or participation in an alternative date. There is no further entitlement to compensation.
​6.2 The tour takes place in all weathers, unless the safety of the participants cannot be guaranteed. In this case, the participant is entitled to an alternative date or a refund of the payment already made.
6.3 If a tour that has already started has to be cancelled due to exceptional circumstances, such as a severe storm or injury to a participant, there is no entitlement to compensation from the contractor.
​6.4 The customer may withdraw from the contract for tours that have already been reserved before the start of the service. In the event of cancellation or rebooking up to 48 hours before the start time, only transaction costs of 2.5% of the amount already paid will be charged. Thereafter, the following fees apply:
​Up to 24 hours before the start of the tour, a 50% cancellation fee is due.
From 24 hours before the start of the tour, no refund is possible.
7. Liability
7.1 The provider shall only be liable for damages in the event of intent or gross negligence.
7.2 Liability for slight negligence is excluded, unless it concerns damages resulting from injury to life, body or health.
8. Duty to co-operate
The tour participant is obliged to co-operate within the framework of the statutory provisions in the event of service disruptions, to avoid or minimise possible damage, in particular to exercise due care. In the event of grossly negligent or disruptive behaviour on the part of a participant or excessive consumption of alcohol, the participant will be excluded from the event without compensation.
9. Data protection
9.1 The provider points out that the customer's personal data will be collected, processed and used to fulfil the contract.
9.2 Further information on data protection can be found in the provider's privacy policy.
10. Consent to the publication of photos
As part of our bike tours, we will occasionally take photos and video recordings that may be published on the website and social media platforms by the contractor. For legal reasons, this is only possible with your consent. If you do not wish to be photographed or filmed, please inform our photographer, guide and/or the contractor accordingly.

11. Severability clause
Should one of the above provisions be or become invalid, this invalidity shall not affect the remaining provisions. The invalid provision shall be replaced by a provision that comes closest to the economic purpose of the provision to be replaced.​

12. Place of jurisdiction
The law of the Federal Republic of Germany shall apply exclusively to these GTC and all legal relationships between the Customer and the Contractor. The exclusive place of jurisdiction for all contractual disputes arising from or in connection with the legal relationship between the Customer and the Contractor shall be Berlin.
